CONCURRENT NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Dunnellon.

REQUEST FOR RELEASE OF FUNDS

On or about June 19, 2018, the City of Dunnellon will submit a request to the Florida Department of Economic Opportunity (DEO) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to make the following improvements:

Activities:
Service Area #1 – Walnut Street Service Area: 

03J – Water Line Replacement Activity – Replace the existing potable water lines in Walnut Street between Illinois Street on the east and the Dunnellon Middle School parking lot on the west, with new six-inch (6”) PVC water lines.  Approximately, two thousand four hundred seventy-five (2,475’) linear feet of replacement potable water lines will be installed.

03J - Sewer Line Replacement Activity – This activity involves the replacement of the existing gravity sanitary sewer service laterals in Walnut Street between Illinois Street on the east and the Dunnellon Middle School parking lot on the west, by open trenching.  This activity also includes the reconstruction of the street once the sanitary sewer service laterals have been replaced.  This activity will involve the replacement of fifty-two (52) sanitary sewer service laterals.

Service Area #1 is bound on the north by the rear property lines of the properties located on the north side of Walnut Street, on the south by the rear property line of the properties located on the south side of Walnut Street, on the east by Illinois Street, and on the west by the Dunnellon Middle School.

A small portion of the activities in Service Area #1 will be carried out within a flood zone.  Approximately 0.25 acres of land located within a floodplain will be included in the Service Area #1 construction area.

Service Area #2 – Park Avenue between Cedar Street and North Ohio Street Street Service Area:

03J – Water Line Replacement Activity – The replacement of the existing potable water lines in Park Avenue between North Ohio Street on the east and Cedar Street on the west, with new six-inch (6”) PVC water lines.  Approximately, seven hundred fifty (750’) linear feet of replacement potable water lines will be installed.

03J Sewer Line Replacement Activity – The replacement of the existing gravity sewer service laterals in Park Avenue between North Ohio Street on the east and Cedar Street on the west.  This activity also includes the reconstruction of the street once the sanitary sewer service laterals have been replaced.  This activity will involve the replacement of twenty-four (24) sanitary sewer service laterals in this service area.

Service Area #2 is bound on the north by the rear property lines of the properties located on the north side of Park Avenue, on the south by the rear property line of the properties located on the south side of Park Avenue, on the east by North Ohio Street, and on the west by Cedar Street.
  
None of the activities in Service Area #2 will be carried out within a flood zone.  

Service Area #3 – The Rolling Hills Apartments Lift Station Renovation Service Area:

03J Sewer Line Replacement Activity - The upgrading of the lift station will include the upsizing of the pumps in the lift station, the installation of automatic air release valves, the replacement of the electrical service panel, the upsizing of the electrical service coming into the lift station from the electrical grid, and the installation of an emergency electrical generator which will keep the lift station operational during periods of electrical power outages.

Service Area #3 is bound on all four sides by the property the Rolling Hills Apartment Complex is located on.    

None of the activities in Service Area #3 will be carried out within a flood zone.  

Approximately 0.25 acres of land located within a floodplain will be included in the primary project construction area.

No additional impervious area will be created in any of the Primary Service Areas included in this project.

03J – Water Line Replacement Activity – Replace the existing potable water lines in Park Avenue between Cedar Street on the east and Orlando Street on the west, with new six-inch (6”) PVC water lines.  Approximately, five hundred fifty (550’) linear feet of replacement potable water lines will be installed.

Service Area #5 Park Avenue between Illinois Street and US Highway 41 Service Area: 

03J – Water Line Replacement Activity – Replace the existing potable water lines in Park Avenue between US Highway 41 on the east and Illinois Street on the west, with new six-inch (6”) PVC water lines.  Approximately, four hundred sixty-five (465’) linear feet of replacement potable water lines will be installed.

Service Area #6 Park Avenue Illinois Street To Ohio Street Service Area:

03J – Water Line Replacement Activity – Replace the existing potable water lines in Park Avenue between Illinois Street on the east and Ohio Street on the west, with new six-inch (6”) PVC water lines.  Approximately, six hundred fifty (650’) linear feet of replacement potable water lines will be installed.

03J – Water Line Replacement Activity – Replace the existing potable water lines in Ohio Street between Chestnut Street on the north and Walnut Street on the south, with new six-inch (6”) PVC water lines.  Approximately, three hundred (300’) linear feet of replacement potable water lines will be installed.

Service Area #9 Ohio Street – Park Avenue to McKinney Avenue Service Area:

03J - Sewer Line Replacement Activity – This activity involves the replacement of the existing gravity sanitary sewer service laterals in Ohio Street between McKinney Avenue on the north and Park Avenue on the south, by open trenching.  This activity also includes the reconstruction of the street once the sanitary sewer service laterals have been replaced.  This activity will involve the replacement of ten (10) sanitary sewer service laterals.

Service Area #9 is bound on the north by McKinney Avenue, on the south by Park Avenue, on the east by the rear property lines of the properties located on the east side of Ohio Street, and on the west by the rear property line of the properties located on the west side of Ohio Street.   

None of the activities in Service Area #9 will be carried out within a flood zone.  

Approximately 0.10 acres of land located within a floodplain will be included in the unmet need project construction areas.

FINDING OF NO SIGNIFICANT IMPACT

The City of Dunnellon has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Dunnellon City Hall located at 20750 River Drive, Dunnellon, FL  34431-6744 and may be examined or copied weekdays 8:30 A.M. to 5:00 P.M.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Jan Smith, Finance Officer, City of Dunnellon, 20750 River Drive, Dunnellon, FL  34431-6744.  All comments must be received by June 18, 2018.  Comments will be considered prior to the City of Dunnellon requesting a release of funds.  Comments should specify which notice they are addressing.

RELEASE OF FUNDS
The City of Dunnellon certifies to the Florida Department of Economic Opportunity and HUD that Walter Green in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Dunnellon to use the CDBG funds.

OBJECTIONS TO RELEASE OF FUNDS
DEO will accept objections to its release of funds and the City of Dunnellon certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:  (a) the certification was not executed by the Certifying Officer of the City of Dunnellon; (b) the City of Dunnellon has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Department of Economic Opportunity, CDBG Program, MSC-400, 107 East Madison Street, Tallahassee, FL 32399-6508.  Potential objectors should contact the City of Dunnellon to verify the actual last day of the objection period.
